Article 1 (Purpose)
The purpose of this terms and conditions is to regulate the rights, duties, responsibilities, and other matters between “Company” and “User” in regard to use of “Unmanned Currency Exchange Machine” (hereinafter referred to as “Service”) provided by DOZN (hereinafter “Company”).
Article 2 (Definition of Terms)
① The terms used in this terms and conditions shall be defined as follows :
1. User : It means a person who grants consent to this terms and conditions, signs a contract with “Company” on using “Service”;
2. Unmanned Currency Exchange Machine : It means an unmanned electric device installed and operated by “Company” to provide the “Service”;
3. Service Screen : It means a screen that includes images and texts displayed on the unmanned currency exchange machine’s display when the “User” uses “Service” of the “Company”;
4. Foren Currency Purchase : It means that the “Company” receives a foreign currency from the “User” through “Unmanned Currency Exchange Machine” and pays KRW currency instead;
5. Foreign Currency Sales : It means that the “Company” receives KRW currency from the “User” through “Unmanned Currency Exchange Machine” and plays a foreign currency instead;
6. Real-Name Verification ID :It refers to a legal certificate, including passport, ID card, and driver’s license, to verify real name of individuals.
② The terms that are not regulated in this terms and conditions shall be applied with relevant statutes and guideline informed on “Service Screen” of the “Unmanned Currency Exchange Machine,” and other matters shall be in compliance with the general commercial practices.
Article 3 (Statement, Effectiveness, and Changes to Terms and Conditions)
① A copy of this terms and conditions shall be provided to the “User” in a electronic document format through the “Service Screen” of the “Unmanned Currency Exchange Machine.”
② This terms and conditions shall be valid upon the “User” grants consent to this terms and conditions.
③ The “Company” may revise this terms and conditions within the extend that they do not violate relevant statutes, including “Act on the Regulation of Terms and Conditions” and “Act on Promotion of Information and Communications Network Utilization and Information Protection.”
Article 4 (Real Name Transaction)
① When using the “Service” of the “Company,” the “User” shall transact under his or her real name. If the “Company” requires “Real Name Verification Certificate” and other necessary data to verify his or her real name or requires the “User” to complete the real name verification method regulated in related statutes, the “User” shall comply with such a request.
② The “User” agrees not to use the “Service” for the purposes of illegal activities, such as unlawful assets or laundering money. The “User” shall be responsible for all damages caused to the “Company” or to the third party for violation of related acts and statutes.
Article 5 (Limit Amount)
A limit amount means the limited amount granted to each “User” when using the “Service” of the “Company.” The limit amount for “Foreign Currency Purchase” and “Foreign Currency Sales” shall be 2,000 USD per day for the same person respectively. If the “User” converts to a currency other than USD, the exchange ratio is re-applied based on USD.
Article 6 (Maintenance and Suspension of Service)
① The operation hours of “Service” shall be 24 hours a day in principle, unless otherwise there exist special business or technical circumstances of the Company. Provided, this shall not apply to days or hours set by the “Company” due to restrictions of “Unmanned Currency Exchange Machine” installation place or other reasons, such as regular inspection.
② The “Company” may suspend the provision of “Service” in any of the following cases :
1. If it is inevitable due to “Service” facility maintenance or other constructions;
2. If telecommunications business operator regulated in the Telecommunications Business Act suspended the telecommunication service;
3. If there is force majeure.
③ The “Company” may restrict or suspend the “Service” wholly or partly when “Service” cannot be provided due to national emergency, power outage, “Service” facility failure, etc.
Article 7 (Duties of Company)
① The “Company” shall have a security system and provide and operate the “Service” stably to make the “User” to use the “Service” safely.
② Notwithstanding Paragraph 2, the “Company” may not provide the “Service” to “User” in any of the following cases :
1. If he or she used someone else’s name;
2. If he or she registered with someone else’s name;
3. If he or she filled out wrong information in “Service” application form;
4. If he or she failed to comply with other legal requirements.
③ The “Company” provides a currency exchange service in accordance with the Foreign Exchange Transactions Act, and it complies with the relevant statutes as a money exchanger.
Article 8 (Duties of User)
① The “User” shall comply with this terms and conditions and matters notified by the “Company” in the “Service Screen.”
② The “User” shall actively cooperate with the “Company” so that the “Company” can provide its “Service” safely.
Article 9 (Collection and Management of Personal Information and Provision to Third Party)
① To comply with the relevant statutes, the “Company” shall collect and manage following personal information by using an electronic information collection method. Provided, additional information may be required if additional information is necessary by the law.
- Purpose of Collection : To check validity of “Real Name Verification Certificate”, to manage limit amount of “Service,” to report transaction details to related authority, and to comply with related statutes
- Personal Information to be Collected (Required):
1) Identification Information : Real name verification number (passport number, resident registration number), image of “Real Name Verification Certificate”
2) Personal Information: Name, nationality, gender, date of birth, issuance date, expiration date, image of “Real Name Verification Certificate,” and currency exchange information, such as exchange amount
- Storage Method and Storage Period : Data and image shall be encrypted and stored for 5 years
② The “User” has the right to refuse to grant consent to collection of personal information stated in Paragraph 1. If the “User” refuses to grant his or her consent, the “Company” cannot provide the “Service” to the “User” pursuant to the related statutes.
③ The “Company” does not provide the personal information of the “User” to Third Party, such as other people and organizations, or the personal information for the purposes irrelevant to use of “Service.”
④ Provided, the “Company” shall provide the personal information when reporting the transaction details to the relevant authority pursuant to the related statutes. If the relevant organization requests the personal information in accordance with due process for public interest, investigation, etc., the “Company” may provide the necessary data to the Third Party.
Article 10 (Service Charge)
① The “Company” charges the “User” of currency exchange charge and transaction charge for using the “Service” provided.
② The currency exchange charge and transaction charge shall be indicated on “Service Screen” in using the “Service,” and they may be changed any time without a separate notification depending on circumstances of the “Company.”
Article 11 (Compensation of Damage)
① If “User” is damaged due to reasons attributable to the “Company,” the scope of damage compensation shall include the general damages regulated in Civil Code. The “Company” shall be responsible for the damages caused by special circumstances only when the “Company” knew or could have known such a circumstance.
② The “Company” shall not be liable for damages caused by the content excluded in Paragraph 1 or transaction that violate this terms and conditions. The “Company” shall be liable for negligence-related disputes between the “Users.”
Article 12 (Indemnity Clause)
① The “Company” shall not be liable in any of the following cases :
1. If it is inevitable due to war, event, natural disaster, or equivalent national emergency;
2. If the damage was caused by the “User” intentionally or negligently.
② The “Company” shall not be liable for content of data posted or transferred by the “User”.
Article 13 (Competent Court and Governing Law)
① If any dispute arises regarding this transaction, it shall be solved by the consent between two contracting parties. Provided, if contracting parties cannot reach agreement or files a lawsuit regarding this transaction, Seoul Central District Court shall be the competent court.
② The legal relationship between “Company” and “User” in using the “Service” shall be governed by the laws of the Republic of Korea.
